Statutes

Employment Standards Act, 2000 (Ontario law): this statute imposes certain minimum standards that must be met by employers and employees in Ontario, including notice/pay instead of notice, severance pay, and maternity/parental leave. It is important to note that this Act sets out only the bare minimum requirements: employees will often be entitled to far more notice or pay instead of notice than the minimum amounts required by this Act: contact Paul McKeever for more information about how much notice is appropriate in your situation.

Canada Labour Code (Federal law): this statute imposes certain minimum standards that must be met by certain federally regulated or operated employers in Canada, including the federal government itself, banks, airlines, Canada Post, etc.

Human Rights Code (Ontario law): among other things, this statutes provides employees with rights not to be discriminated against or harrassed by employers or other fellow employees on the basis of certain personal characteristics, including race, sex (including pregnancy), religion, nationality, disability etc.

Canada Human Rights Act (Federal law): among other things, this statutes provides federal employees, and employees in industries under federal jurisdiction (e.g., banks, airlines, Canada Post, etc.) with rights not to be discriminated against or harrassed by employers or other fellow employees on the basis of certain personal characteristics, including race, sex, religion, nationality, disability etc.

Employment Insurance Act (Federal law): Canada's employment insurance system is set up by this law, and the regulations made pursuant to it. It describes such things as when a person is eligible to receive employment insurance, and the amounts that they will receive.


Government

Ministry of Labour (Government of Ontario) - Employment Standards Branch: this branch of the Ontario Ministry of Labour administers the Employment Standards Act. Claims for termination pay and/or severance pay can be made to this branch. However, making a claim under the Employment Standards Act will often prevent a person from pursuing a much larger amount of compensation in the courts. Human Resources and Skills Development Canada (Federal Government) - Labour Program: This program administers regulations made pursuant to the Canada Labour Code.

Human Rights Commission (Government of Ontario): This commission administers the Human Rights Code. Human rights complaints are filed with this commission with or without the assistance of an employment lawyer. Contact Paul McKeever if you would like assistance in making or responding to a human rights complaint.

Canadian Human Rights Commission (Federal Government): This commission administers complaints made under the Canada Human Rights Act.

Human Resources and Skills Development Canada (Federal Government) - Employment Insurance: This department administers employment insurance in Canada. If you would like to appeal a decision made by the Employment Insurance Commission, contact Paul McKeever for assistance.
